The large majority of residential real estate in Montana is bought and sold using a Buy and Sell Agreement. Most of these contracts are on a form provided by the Montana Association of Realtors. The Montana Supreme Court has held that these forms, when properly completed and executed, are valid contracts under Montana Law. The good news is that they usually contain terms which make a strong case for enforcement, including an attorney fees provision and rights to specific performance for both parties.
